Booking Terms & Conditions

1. Definitions

In these Booking Conditions, references to:

  • “we”, “us” and “our” refer to Muddy Boots 4×4 Adventures, our employees and any contractors carrying out work on our behalf.
  • “you” and “your” refer to the first named person on the booking and all persons on whose behalf a booking is made or any other person to whom a booking is added or transferred.   
     
  • “Trip” refers to the booking this document refers to.

 

2. Booking

By making a booking for a Trip on our website, the first named person on the booking agrees on behalf of all persons detailed on the booking that they:

  • have read these Booking Terms & Conditions, our Website Terms Of Use and Privacy Policy, and have the authority to and do agree to be bound by them;   
     
  • consent to our use of personal data in accordance with our Privacy Policy and is authorised on behalf of all persons named on the booking to disclose their personal details to us, including where applicable special categories of data (such as information on health conditions or disabilities and dietary requirements);   
     
  • are over 18 years of age;
  • accept financial responsibility for payment of the booking on behalf of all persons detailed on the booking.   
     

 

3. Booking Process

For all trips, a 25% deposit is required at the time of booking with the balance paid no later than 28 days prior to the trip starting. Once a deposit is received you’re provisionally booked onto the trip, subject to the full balance being paid within the stated time scale.

A booking is made when you pay the total deposit amount stated above.

Upon receipt of your deposit, we will send you a booking form and confirmation via email that your place has been booked subject to these Terms and Conditions. The booking form must be filled in with all required information and returned to us within 14 days of receipt (or prior to departure if booked within 14 days of the tour start date). Failure to return the booking form or contact us will result in cancellation and loss of your deposit.   

We will contact you at various stages prior to the Trip start date request any additional information as required from time to time.

A binding contract will exist between us once we have sent you a confirmation of your booking. It is your responsibility to inform us of any errors on any booking documents, confirmations or other documents that we send you.   

The final balance for your Trip is due for payment no less than 28 days before the start date of your Trip. If full payment is not received by this date, we reserve the right to cancel your booking.  No refunds of any monies paid will be due to you.   

 

4. Documents and Insurance

As part of your booking, you must arrange the following insurances as a minimum:

  • Car Insurance covering you and all drivers for the minimum legal required level in the territories you will be driving; we recommend fully comprehensive insurance.
  • Car breakdown insurance covering you in the territories you will be driving. Breakdown insurance should cover repatriation for you and your vehicle back to the UK in case your vehicle cannot be repaired in reasonable time.
  • Comprehensive Travel Insurance, covering any pre-existing medical conditions. We highly recommend that your cover should include cancellation cover, and that you purchase your insurance at the same time you book your Trip with us.

You will be required to carry the following documentation during the Road Trip:

  • Driving Licence – all drivers must hold a valid full UK driving licence
  • Vehicle insurance Certificate for all drivers
  • V5C (log book) or ‘vehicle on hire’ certificate
  • MOT certificate
  • Valid Passport – for all participants – with at least six months validity on the last day of the trip.
  • Travel Insurance Certificate

We reserve the right to ask for proof that you hold these insurances either before or during the Road Trip and to cancel your booking if you are found not to have any of these insurances. If we cancel your booking on these grounds, no refund of any monies paid will be due to you.

In case you travel without any insurance, we will not be liable for any consequences that arise as a result.

 

5. Cancellation by You

If you have to cancel your trip you must endeavour to give as much notice as possible. Any travel arrangements that we have booked for you must still be paid for. Any monies paid by you will be transferred to another trip. No refunds are given for road trips.

 

6. Cancellation or Change by Us

As we plan your Trip arrangements many months in advance, including test drive of all routes to grade them, unless stated otherwise. We may occasionally have to make changes or cancel your booking or change the planed route due to circumstances our of our control eg fire, flood etc and we reserve the right to do so at any time. 

 

7. Administration Charges

We may charge administration fees for certain booking changes, such as modifying the vehicle or participant details. These fees will only apply if the change incurs additional costs for us. You’ll be informed of any applicable fees before the change is made, and they must be paid in advance.

 

8. Driver Responsibilities

  • Lead Driver:
    • Ensure all required documents are carried in the vehicle throughout the trip.
    • Verify the vehicle’s safety and roadworthiness before each journey.
  • All Drivers:
    • Possess a valid UK driving license for the appropriate vehicle category throughout the trip.
    • Be medically fit to drive according to UK and European laws.
    • Avoid driving under the influence of substances that may impair judgment, including alcohol, prescribed drugs, or illegal drugs.
    • Adhere to all applicable traffic laws and regulations in the countries they drive through.
    • Drive with reasonable care and skill and agree to indemnify us for any claims arising from negligent, reckless, or irresponsible driving.
    • Be responsible for any fines incurred due to their driving during the trip.

 

9. Personal Behaviour

Road Trips are not races or competitions. Engaging in competitive behaviour may result in removal from the trip without a refund.

Participants must behave in a manner that doesn’t disrupt the enjoyment of others or cause inconvenience to service providers. We are not liable for any actions taken against you by third parties due to antisocial or unreasonable behaviour.

 

10. Foreign Office Advice

It is your responsibility to stay informed about Foreign & Commonwealth Office advice regarding the territories you’ll be traveling through.

 

11. Image Rights and Photography

All participants consent to being photographed and filmed during the trip. You agree to the use of your name, image, likeness, voice, and biographical information for promotional purposes. Participants may take non-commercial photos and videos of the event.

 

12. Force Majeure

We are not liable for cancellations or delays caused by events beyond our control, such as natural disasters, terrorism, or government actions. These events are considered “Force Majeure.”

 

13. Terms and Conditions Changes

We may modify these terms and conditions at any time. You’ll be notified of changes, and your continued participation in the trip will be deemed as acceptance of the updated terms.

 

14. Assistance

If you need assistance during the trip, we’ll will aid  in sourcing mechanical or medical resources. We may also offer roadside assistance if possible and safe. However, we cannot be held liable for any costs arising from such incidents. It’s recommended to have appropriate insurance coverage.

 

15. Consumer Protection

Muddy Boots 4×4 Adventures is committed to customer satisfaction and financial protection. All passengers booking a tour with us are protected under the Package Travel Regulations 2018, ensuring the security of your initial deposit and subsequent payments.

 

16. Indemnity

You agree to indemnify us against any claims arising from your actions or participation in the trip, including violations of laws or regulations or breaches of these terms and conditions.

 

17. Violation of Terms

Violating these terms or refusing to follow instructions may result in being prohibited from further participation in the trip.

 

18. Governing Law

These terms and conditions and your participation in the Trips are governed by English law, and you agree to submit to the jurisdiction of the English Courts.

Privacy Policy

This privacy policy applies between you, the User, and Muddy Boots 4x4 Adventures(Muddy Boots), the owner and provider,  in relation to your use of the website and other products and services ("Services"). Muddy Boots takes the privacy of your information very seriously. This privacy policy applies to our use of any and all Data collected by us or provided by you. 

 

Please read this privacy policy carefully.

Definitions and interpretation

  1. In this privacy policy, the following definitions are used:

Collectively, all information that you submit to Middy Boots via our Services. This definition incorporates, where applicable, the definitions provided in the Data Protection Laws;

Trips organized by Muddy Boots under their own terms and conditions.

 

  1. In this privacy policy, unless the context requires a different interpretation:
    1. the singular includes the plural and vice versa;
    2. references to sub-clauses, clauses, schedules or appendices are to sub-clauses, clauses, schedules or appendices of this privacy policy;
    3. a reference to a person includes firms, companies, government entities, trusts and partnerships;
    4. "including" is understood to mean "including without limitation";
    5. reference to any statutory provision includes any modification or amendment of it;
    6. the headings and sub-headings do not form part of this privacy policy.

Scope of this privacy policy

  1. This privacy policy applies only to the actions of Muddy Boots and Users with respect to our Services. It does not extend to any Websites that can be accessed from our Services including, but not limited to, any links we may provide to social media websites.
  2. For purposes of the applicable Data Protection Laws, Muddy Boots is the "data controller". This means that Muddy Boots determines the purposes for which, and the manner in which, your Data is processed.

  1. We may collect the following Data, which includes personal Data, from you:
    1. name;
    2. contact Information such as email addresses and telephone numbers;
    3. Vehicle registration

in each case, in accordance with this privacy policy.

Data that is given to us by you

  1. Muddy Boots will collect your Data in a number of ways, for example:
    1. when you contact us through our Services, by telephone, post, e-mail or through any other means;
    2. when you register with us and make a booking to receive our services;
    3. when you make payments to us, through our Services or otherwise;
    4. when you use our services;

in each case, in accordance with this privacy policy.

Data that is collected automatically

  1. To the extent that you access our Services, we will collect your Data automatically, for example:
    1. we automatically collect some information about your Services. This information helps us to make improvements to content and navigation, and includes your IP address, the date, times and frequency with which you access our Services and the way you use and interact with its content.

  1. Any or all of the above Data may be required by us from time to time in order to provide you with the best possible service and experience when using our Services. Specifically, Data may be used by us for the following reasons:
    1. internal record keeping;
    2. improvement of our products / services;
    3. transmission by email of marketing materials that may be of interest to you;
    4. contact for market research purposes which may be done using email, telephone, or mail. Such information may be used to customise or update our Services;

  3. When you register with us and set up an account to receive our services, the legal basis for this processing is the performance of a contract between you and us and/or taking steps, at your request, to enter into such a contract.

Who we share Data with

13.We may share your Data with  employees, agents and/or professional advisors, to assess and develop the quality of our Services, in accordance with this privacy policy.

Keeping Data secure

  1. We will use technical and organisational measures to safeguard your Data,

Your rights

    3. Right to erase - the right to request that we delete or remove your Data from our systems.
    4. Right to restrict our use of your Data - the right to "block" us from using your Data or limit the way in which we can use it.
    5. Right to data portability - the right to request that we move, copy or transfer your Data.
    6. Right to object - the right to object to our use of your Data including where we use it for our legitimate interests.

  1. Our Services may, from time to time, provide links to other websites. We have no control over such Websites and are not responsible for the content of these websites. This privacy policy does not extend to your use of such websites. You are advised to read the privacy policy or statement of other websites prior to using them.

Changes of business ownership and control

  1. Muddy Boots may, from time to time, expand or reduce our business and this may involve the sale and/or the transfer of control of all or part of Muddy Boots. Data provided by Users will, where it is relevant to any part of our business so transferred, be transferred along with that part and the new owner or newly controlling party will, under the terms of this privacy policy, be permitted to use the Data for the purposes for which it was originally supplied to us.
  2. We may also disclose Data to a prospective purchaser of our business or any part of it.
  3. In the above instances, we will take steps with the aim of ensuring your privacy is protected.

General

  1. You may not transfer any of your rights under this privacy policy to any other person. We may transfer our rights under this privacy policy where we reasonably believe your rights will not be affected.
  2. If any court or competent authority finds that any provision of this privacy policy (or part of any provision) is invalid, illegal or unenforceable, that provision or part-provision will, to the extent required, be deemed to be deleted, and the validity and enforceability of the other provisions of this privacy policy will not be affected.
  3. Unless otherwise agreed, no delay, act or omission by a party in exercising any right or remedy will be deemed a waiver of that, or any other, right or remedy.
  4. This Agreement will be governed by and interpreted according to the law of England and Wales. All disputes arising under the Agreement will be subject to the exclusive jurisdiction of the English and Welsh courts.

Changes to this privacy policy

  1. Muddy Boots reserves the right to change this privacy policy as we may deem necessary from time to time or as may be required by law. Any changes will be immediately posted on our Services and you are deemed to have accepted the terms of the privacy policy on your first use of our Services following the alterations.
